Hearing Against Illinois Tollway Authority Postponed Until Monday October 31st

The motion, filed by Taxpayers United of America, was originally scheduled to be heard on Oct. 26, 2011, but will now take place on Monday, October 31, 2011, at 11:15 a.m. in Room 2402 of the Richard J. Daley Center, 50 West Washington Street. The restraining order is seeking to prevent the 90% toll tax increase from taking effect on Jan. 1, 2012.

The lawsuit is asking the Court to certify the case as a class action on behalf of all tollway users. TUA will ask the court to enforce the original intent of the tollway legislation and end the Illinois tollway system. If the Court allows the temporary restraining order, it will then be asked to consider an injunction to stop the toll increase.

Taxpayers United of America Seeking Plaintiffs in Suit Against Illinois Tollway Authority

CHICAGO–Taxpayers United of America is going to court to seek a temporary restraining order against the Illinois Tollway Authority to prevent the unconscionable, 90 percent hike in tollway taxes that are due to take effect January, 2012. Our efforts will be helped greatly if you would agree to join as a plaintiff.
The tollways were set up by legislators to be built and then converted to freeways when they were paid off in 1973. Rather than following the legislative intent, the Tollway Authority has run wild and has self-perpetuated itself by building more and more tollways, and now even plans to convert a free highway to a tollway.
While the middle-class is getting squeezed by this recession, tollway administrators are raking in the big bucks as they perpetuate their jobs!

We must unite and show the tollway administrators and their politically-connected contractors that we won’t put up with this any longer.
Playing an active role and becoming a plaintiff does not mean you will accrue costs. All of the costs are being borne by our organization.
Please help us stop this out-of-control authority by joining on as a plaintiff. If you are interested, send us an email with your name, address and your most frequented tollway. If you have any questions, please call the number listed above for further information. Thanks!

CHICAGO–Attorneys for Taxpayers United of America (TUA) will ask Circuit Court Judge Rita M. Novak for a restraining order against the Ill. Tollway Authority and Electronic Transaction Consultants Corporation, a Texas Corporation, seeking to prevent huge increases in tolls scheduled to take effect on Jan. 1, 2012. The restraining order is on behalf of Jim Tobin, TUA President, Christina Tobin, TUA Vice President, Rae Ann McNeilly, Director of Outreach for TUA, and two Wisconsin drivers, Glenn Westphal and Carol Westphal. The lawsuit is asking the Court to certify the case as a class action on behalf of all tollway users.
“The Illinois Tollway System was created in 1953, and the Tollway Act requires the tollways to be converted to freeways and the Tollway Authority to dissolve itself,” said Tobin. “It has done neither. Instead, the Authority adopted a 15-year, $12 Billion Capital Plan on August 25, 2011, with no intent to comply with these statutory requirements, but to perpetuate its existence and convert the Elgin-O’Hare freeway into a tollway.”
“TUA will ask the court to enforce the law and end the Illinois tollway system,” said Tobin. “If the Court allows the temporary restraining order, it will then have time to consider an injunction to stop the 90 percent toll tax increase.”
The motion is scheduled to be heard on Oct. 26, 2011, at 11:15 a.m. in Room 2402 of the Richard J. Daley Center, 50 West Washington Street, Room 2402.
